By accessing or using the ECHO360 agency assessment platform (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
ECHO360 provides an agency assessment and feedback platform that enables organizations to collect, analyze, and report on performance assessments of their agency partners. The Service includes survey distribution, data collection, analytics, and reporting features.
Access to the Service is provided through unique login credentials. You are responsible for maintaining the confidentiality of your login information and for all activities that occur under your account.
The Service is intended for use by authorized personnel within organizations that have contracted with ECHO360. You may not share your access credentials with unauthorized individuals.

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection, use, and sharing of your information as described in the Privacy Policy.
The Service, including all content, features, and functionality, is owned by ECHO360 and is protected by copyright, trademark, and other intellectual property laws.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use the Service for your internal business purposes.
You retain ownership of any content you submit through the Service (survey responses, feedback, etc.). By submitting content, you grant us a license to use, store, and process that content to provide the Service.
You acknowledge that the Service may contain confidential and proprietary information. You agree to maintain the confidentiality of such information and not disclose it to third parties without authorization.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or completely secure.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ECHO360 SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
You agree to indemnify and hold harmless ECHO360 from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.
We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms.
We may modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions.
Any disputes arising from these Terms or your use of the Service shall be resolved through the courts of Ontario, Canada.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
